This strategy targets staff and stakeholders in the agriculture sector by focusing on development of skills, knowledge and competences in technical, policy and legislation. It provides guidance on sector institutional requirements for efficient and effective delivery of services. It is expected that both levels of government and other stakeholders will support capacity building at individual, institutional (organizational) and the enabling environment (systems) for players in the entire agricultural value chains.

The strategy is a response to current state (and desired state) recognition of drivers and pressures, and their impacts on society. Using the DPSIR framework and a combination of analytical and feedback from national dialogue, meeting with communities, a list of actions was developed. This list informed the formulation of this strategy. It resulted in the development of innovative responses and prioritization of their interventions.

The objectives and purpose of these regulations are to give effect to section 40 of the crops act, 2013; to provide for licences to be issued by the licensing authorities; to provide for the obligations of licence holders and service providers, and the protection and regulation of their interests along the value chain; recognize the grower of coffee as the owner of coffee until the coffee is sold and paid for, provide for protection of growers’ rights along the value chain; provide for a transparent and timely clearing and settlement of coffee sales proceeds to the growers and service providers; provide for the collection and maintenance of data related to coffee; ensure improvement of coffee standards, increased production and support; and regulate the coffee industry in Kenya. The regulations define functions of the agriculture and food authority established under section 3 of the agriculture and food authority act, 2013.

Crustacea include all species of shrimps, prawns, lobsters, crawfish and crabs, including brood, spawn, ova, and young thereof (reg. 2). A crustacea licence in the form shown in the first schedule is required for the delivery, sale, and purchase, disposal, marketing or processing of crustacea (reg. 5). These regulations shall not apply to quantities not exceeding two kilograms for own personal consumption, to resale by persons who purchased from a person who has been granted a licence, and to employees of persons who have been granted a licence. These regulations emphasize that every tea packer shall apply for a registration and shall be required to register with the tea board of Kenya in the prescribed manner. every packer shall deliver to the board a monthly return stating the tea packed in the previous month and the source of such tea. Packing of tea in contravention of this rule is declared an offence which may bring about imprisonment.

It emphasizes that no person shall in any tea growing area: sun-dry or otherwise manufacture or prepare tea except in accordance with the terms of a manufacturing license issued under section 13 of the Act; or sell, give away or otherwise dispose of any made tea manufactured or prepared in contravention of sub-paragraph (a) or this paragraph; or (c) convey, buy or otherwise acquire, or be in possession of, any made tea manufactured in contravention of sub-paragraph (a) of this paragraph. Contraventions of the above-stated rules, obstruction of persons acting in pursuance of these Regulations or the withholding of information are declared offences. Tea belonging to convicted persons shall be confiscated and authorized officers are given extensive investigative powers.

Kenya tea development authority shall incorporate a limited liability company under the provisions of the companies Act for the purpose of bringing the provisions of this order into operation.. The company shall be the successor of the Kenya tea development authority and, subject to this order, all rights, duties, obligations, assets and liabilities of the Kenya tea development authority existing on the appointed day shall be automatically and fully transferred to the Kenya tea development agency limited and any reference to the Kenya tea development authority in any contract or document shall, for all purposes, be deemed to be reference to the company.

These rules emphasize that where any imported goods are found in the possession Of control of any person or are found in the premises of any person carrying on trade, that person shall be deemed to have the goods for sale and the onus of proving the contrary shall be upon him. Regulation 6 provides for grading of eggs.

The National Agribusiness Strategy aims at enhancing the development of agricultural sector to ensure domestic and international competition, provides information on agribusiness in Kenya and necessary implementation strategies.

However, agricultural sector development support programme II adopts new structures that were not wholly realized during implementation of agricultural sector development support programme I. This parliamentary Act repeals and replaces the constituencies development fund act, 2007. It makes general provisions on form of arbitration agreement, waiver of right to object, stay of legal proceedings, interim measures by court, death of a party, and receipt of written communications and extent of court intervention.
