The regulations are subject to the biodiversity act of 2004. They provide rules for bioprospecting and the commercialization of indigenous biological resources, regulate the permit system, regulate the exportation of indigenous biological resources for other research purposes, provide for an appeal against decisions taken by relevant authorities, define offences, and spell out penalties for such offences.

Based on the animal diseases act of 1964, the minister imposes tariffs for the issue of permits for the importation of animals and animal products. It is clearly stated that tariffs shall be payable by people who import or contemplate importing animals and animal products into South Africa.
